Rental Agreement


*Check-In and Check-Out Time is between 9:00AAM – 17:00PM*
Late Check-Out after 17:00PM will be charge additional Baht 2,000
***For Check-out need to inform the rental office 7 DAYS in advance ***
***The Deposit will not refund if the “Tenant” check-out before the Check-Out date stated in this agreement ***

IMPORTANT REMARKS:

1) Customer have no right to change the door key’s or any key’s for the room A fine of 3,000 Baht for violation.


2) Both parties agree that the Rental Management has the full right to move the Rental customer to another unit with similar specification as the unit rented provided that the Rental Management will give notice 30 days in advance.


3) Both parties agree that the Rental Management has the full right to show the unit to any prospect customer at any day and time provided that the Rental Management will inform the customer by message.

SMOKING AREA:

  1. No smoking inside the unit
  2. No smoking inside the hallways
  3. No smoking inside the building
  4. Smoking in designated area only (balcony)
  5. A fine of 3,000 Baht for every violation

Hereafter entered in this agreement, wherein both parties agree to the following terms and condition::

• The “Tenant” agreed to pay the rental and utilities every 5th of each month, penalty of Baht 100 will be charge for the late payment, in case that the “Rental Management Company” doesn’t received the payment within 10th of the month, the ” Rental Management Company ” has the right to turn-off the utilities of the unit. In case that the “Tenant” fails to pay the rental and utilities in 1 monht, the ” Rental Management Company ” has the right to lock-up the unit and terminate this agreement.


• On today, the “Rental Management Company” provide the unit in good condition including the unit keys, key card and all furniture in the unit, likewise, the “Tenant” has checked and agreed that the premise are all in good condition and shall return to the ” Rental Management Company ” in the same condition when the rental expires. If the keys are lost or furniture are damaged , the ” Tenant ” will responsible for the cost of such damage.


• The rental period not less than 1 month.


• The “Tenant” cannot pay any monthly rent, utilities, cleaning, laundry or any payment fee related to rental to any person aside from the rental staff in the rental office located in City Garden Tower.


I agreed and understood all conditions stated in this agreement and will follow accordingly. In witness hereof, both parties have herein set their
signature below:

Penalty:

  1. If any tenant received 3 complaints from the co-owner or residence. The committee will suspend water and electric supply for this unit until the Tenant has leaved the apartment.
  2. Cleanliness Offense such garbage dumping at Common area, sweep and left the dust at corridor, left the garbage bag on the corridor or other cleanliness offense on common area. The owner of the violated apartment will be fined in amount of the cleaning cost which at least 500 baht per occasion.
  3. Use of apartment offense. The tenant shall use the apartment cautiously which not cause any trouble and disturb to person or other apartment such as no loud music especially at night time, no games or a party with a loud noise, no big controversy etc. The unit which has been complained and verified as complaint will be charged 2,000 baht per occasion.
  4. Use of common area offense. The tenant shall use the common properties in accordance with its purpose and regulations. The tenant who fail to comply then occur to interfere or risk other resident life safety or damaging of any property will be charge 1,000 baht. In case of the tenant has miss use of common property and cause any damage to it, that the tenant shall respond to the cost of reparation or replacement.
  5. Safety offense. The tenant shall not take any action which would effect to building security such as store or keep things blocked fie escape door, left open the fire escape door, move/change/adjust or play with fire alarm system, move or block CCTV camera etc. Offenses effect any building security will be charged 1,000 baht per occasion.
  6. The tenant shall park the vehicle at provided area, 500 baht fine will be charged per miss parking.

THE “TENANT” agrees:

  1. To use the premises for dwelling purpose only by the Tenant and immediate family. The Tenant hereby agrees to observe and comply with the Tenant’s obligations set forth in this agreement in all respects. For the purposes of this agreement, any breach, non- observance or default of this agreement by the Tenant, are subject to the remedy set forth herein with respect thereto.
  2. To permit the Rental Management Company or representative to enter the premises ( Notice 1 week ) to do repairs for the premises, for the unit above and below the premises.
  3. Not to damage or deface the premises or make any structural alterations or additions threrto without the previous consent in writing of the Rental Management Company, provided that any fixture or fitting not being structural alteration or addition that may have been installed by the Tenant, may be removed by him/her at the termination hereof.
  4. To let the owner enter the premises anytime after giving 1day notice and to move the tenant to other unit similar or better to the one they renting with valid and reasonable explanation after a week notice
  5. To take care of and to preserve the premises as a normal person would do to his/her own and to maintain the upkeep of, and also attend to repairs any damage of the premises that caused by the negligence or willful misconduct of the Tenant
  6. Not to do or permit to be done on the premises anything which may cause annoyance or disturbance to the neighbours. The Tenant agrees to comply with the published rules, regulations and notices issued by the Condominium juristic committee.
  7. Not assign or sublet the premises or any part thereof without the previous consent of the Rental Management Company in writing, which consent will be not be unreasonably withheld by the Rental Management Company. And shall not allow occupancy or possession of the premises to be taken, whether wholly or partially, to or by any third party, and shall not make or allow to be made any unlawful, improper or offensive use thereof, and no
    alterations, additions or removal shall be made in or to or from the premises.
  8. To use the premises for dwelling purpose only by the Tenant and immediate family. The Tenant hereby agrees to observe and comply with the Tenant’s obligations set forth in this agreement in all respects.   15. Not to do, permit or suffer to be done any act or thing, which may void or make void any policy of insurance, which the Rental Management Company may have affective, upon the premises.
  16. All common facilities of the development are for use the tenant and their family only, in accordance with rules and regulation relating to usage as lay down from time to time by the Condominium juristic committee. The domestic help are strictly forbidden to use the common facilities of the Condominium.
  17. The deposit is non-interest bearing; The tenant may not use the deposit as ground for not paying amounts otherwise due and payable.
  18. The Rental Management Company may deduct from the deposit on account of such payment due to the Rental Management Company, and refund the remaining portion thereof (if any) to the Lessee, or otherwise claim for any outstanding amount from the Tenant the expiration or termination of the agreed rental period.
  19. The lease agreement shall terminate before 1 month by Rental Management Company and shall refund the deposit to the Tenant
  20. The Rental Management Company does not allow the Tenant to be involved in any unlawful exercises or to possess any illegal items such as drugs, deadly weapon etc. inside the premises. If the Tenant will be involve in any illegal acts. The Rental Management Company will not be responsible and should not be involved for any committed crime
  21. The Rental Management Company will not responsible any assets belonging to the Tenant
  22. If the tenant would like to terminate the agreement before the expiration, the Rental Management Company shall have the right to keep the security deposit and remaining amount.
